Terms and Conditions

 By registering as a Bidder and/or participating in any auction sale conducted by BidYourself.com (Will Cupp 865-654-9807), the Bidder acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions. All Bidders and participants must adhere to these terms in order to participate in any auction or purchase of property.

2. Buyer’s Premium
A 10% buyer's premium will be added to the highest bid. For example, for a $600,000 bid, a 10% buyer's premium of $60,000 will be added, making the total purchase price $660,000.

3. Payment Terms

• Deposit: The      successful Bidder must deposit 10% of the total purchase price (including      the Buyer’s Premium) immediately at the conclusion of the auction via wire      transfer, cashier’s check, personal check, or company check. The deposit      must be received on the day of the auction. (Using Example above deposit would      be $6600).  Contact Will Cupp the      exact amount needed after Auction! 
• Final Payment: The balance      of the purchase price must be paid in certified funds at closing.
• Closing: Closing must      occur within 30 days of the sale date, with no extensions granted.

4. Closing and Property Transfer

• Timeline: Closing must      occur within 30 days of the sale date, with no extensions.
• Survey: No survey      will be provided for the property.
• Closing Process: Closing will      be handled by the title company, and the seller will provide the deed.      Title company costs will be split equally between the buyer and seller.      Taxes will be prorated as of the closing date unless otherwise stated.

5. Buyer’s Responsibilities
The Buyer is responsible for:

• Title search,      title opinions, mortgagee’s policy, owner's policy, and title insurance.
• Homeowner’s      association (HOA) fees, transfer fees, or membership fees.
• Transfer taxes      and recording fees for the deed of conveyance and deed of trust.
• Buyer’s closing      fees, document preparation fees, and/or attorney’s fees.
• Deposits for      insurance premiums, taxes, and prepaid interest.
• Insured Closing      Protection Letter and any association fees.
• All fees      related to inspections of the property.

The property will be conveyed by its existing legal description referenced in the title commitment.

6. Environmental Law Waiver
Buyer agrees to accept the Property without recourse against Seller of any kind under applicable laws and regulations. By acceptance of the deed to the Property, Buyer shall have released and waived any claim against or rights of contribution against Seller or Agent under any Environmental Law for environmental conditions at the Property that may exist as of the closing date, and such release and waiver shall survive the closing and the transfer of title to the Real Property. For purposes hereof, “Environmental Laws” includes, without limitation, the Comprehensive Environmental Response, Compensation and Liability Act of 1980, as amended (42 U.S.C. § 9601, et. seq.), the Hazardous Materials Transportation Act, as amended (49 U.S.C. § 108, et. seq.), the Resource Conservation and Recovery Act, as amended (42. U.S.C. § 6901, et. seq.), the Toxic Substances Control Act, as amended (15 U.S.C. § 2601, et seq.), the Clean Water Act, as amended (33 U.S.C. § 1251, et. seq.), and/or any corresponding state law and the regulations, rules, ordinances, decisions, orders, or determinations of a judicial or governmental entity.

7. Cash Sale
This auction is a cash sale and is not contingent on the Purchaser’s ability to obtain financing or any other contingencies.

8. Registration and Bidding
By registering as a Bidder and/or participating in the auction, you agree to abide by these Terms and Conditions. The Auctioneer has full discretion over the conduct of the auction and reserves the right to reject any bid. When bidding on any Real Estate, all bidders must submit A letter from a Bank with Proof of Funds.  All Funds must be verifiable!   If you are getting a loan, You must send an approval letter with the name of Bank or Mortgage company and the Loan originator name and phone number. All letters will be verified!!!! Auctioneer reserves the right to refuse any bidder registration At Auctioneers desecration.  Call Will Cupp 865-654-9807 before attempting to bid. 

9. Bidder Responsibility
It is the responsibility of each Bidder to thoroughly inspect the property and verify all information before placing a bid. All items are sold "as-is, where-is." By placing a bid, the Bidder agrees to be bound by their offer and acknowledges that once a bid is made, it cannot be retracted.

10. Guaranty Agreement
By submitting a bid, the Bidder personally guarantees the payment of any bid amount that is not paid when due, along with any collection expenses incurred, including attorney’s fees.

11. Property Condition and Disclosure
The property is being conveyed “as-is, where-is” with all faults, including any existing environmental conditions, zoning, HOA/POA fees, and potential title issues. Neither BidYourself.com (Will Cupp 865-654-9807) nor the Seller makes any warranties or representations regarding the property’s condition. The Buyer assumes full responsibility for conducting their own inspection and verification of all aspects of the property before bidding.

12. Inspection and Due Diligence
Bidders are encouraged to conduct their own research and due diligence, including physical inspections and reviewing public records, prior to placing a bid. Neither BidYourself.com (Will Cupp 865-654-9807) nor the Seller will be responsible for any omissions or inaccuracies in property descriptions or representations.

13. Closing and Possession
Possession of the property will transfer to the Buyer at the time of closing, once all required payments and documentation are completed.

14. Wire Fraud Disclaimer
Important Notice Regarding Wire Transfers:
Wire fraud is a serious issue, and BidYourself.com (Will Cupp 865-654-9807) takes every precaution to ensure that all transactions are secure. However, it is the responsibility of the Buyer to verify the bank details provided before sending any funds.

• Beware of      Fraudulent Emails: Do not rely solely on emails or      other communications for wiring instructions. Always verify any wiring      instructions directly with BidYourself.com (Will Cupp 865-654-9807) by      calling the official contact number listed on our website.
• Official      Communication: BidYourself.com (Will Cupp 865-654-9807) will never send changes      to wire instructions via email or text message. Any change in wire      instructions should be confirmed by calling us directly at the number      provided on our website.
• Buyer’s      Responsibility: The Buyer assumes full responsibility for ensuring that the funds      are sent to the correct bank account. BidYourself.com (Will Cupp      865-654-9807) will not be held responsible for any funds sent to      fraudulent accounts or third-party entities, even if the transfer was made      under false pretenses.
• Fraud      Prevention: We recommend that the Buyer immediately contact their bank if they      suspect they have been a victim of wire fraud or if they believe the      wiring instructions may have been compromised.

By proceeding with payment via wire transfer, you acknowledge that you understand the risks of wire fraud and agree to take all necessary precautions to protect yourself. BidYourself.com (Will Cupp 865-654-9807) will not be liable for any losses resulting from wire fraud or fraudulent transactions.

15. Online Bidding Notice
Bidders participating in the online auction are encouraged to place maximum bids ahead of time to avoid potential internet lags. BidYourself.com (Will Cupp 865-654-9807) is not responsible for any issues or malfunctions related to internet connectivity, nor for missed bids due to such issues.

16. Suspension of Bidding Privileges
BidYourself.com (Will Cupp 865-654-9807) reserves the right to suspend or revoke a Bidder's privileges to bid at any auction if the Bidder engages in unsafe or illegal activities or violates any of these Terms and Conditions. Attempting to re-register after being suspended, including using a third-party account, may result in civil and criminal liability.

17. Auctioneer’s Rights
BidYourself.com (Will Cupp 865-654-9807) reserves the right to withdraw or re-catalog items and to refuse any bids that do not conform to these Terms and Conditions. The Auctioneer’s decision is final.

18. Privacy and Data Protection
BidYourself.com (Will Cupp 865-654-9807) is committed to protecting your personal information. We comply with all applicable privacy laws and regulations and will not share your information with third parties without your consent, except as required by law.

19. Force Majeure
BidYourself.com (Will Cupp 865-654-9807) and the Seller are not liable for failure to perform their obligations due to events beyond their control, including but not limited to natural disasters, strikes, technical failures, or other events of force majeure. In such cases, the auction may be postponed, and the parties will work to reschedule.

20. Liability Waiver
By participating in the auction, the Bidder agrees to waive any claims against BidYourself.com (Will Cupp 865-654-9807), its agents, or the Seller for any loss, damage, or dispute arising from the auction or the condition of the property.

21. Dispute Resolution
In the event of a dispute between Bidder and BidYourself.com (Will Cupp 865-654-9807), both parties agree

Confirmation of Auctioneer/Real Estate Agent's Agency 

Please be advised that the Auctioneer, Will Cupp, is also a licensed real estate agent in the State of Tennessee and will act as the designated agent for the Seller in this transaction. As the Seller's agent, Will Cupp (BidYourself.com) has a fiduciary duty to the Seller, and any information provided to the Auctioneer may be disclosed to the Seller.

Buyer Representation:
Buyers are strongly advised to seek independent representation before placing a bid in this auction. If you already have a Buyer’s Representative, please ensure that your agent contacts the Auctioneer (Will Cupp) prior to placing a bid to confirm their involvement in the transaction. This is important for the protection of your interests.

Referral Fee for Licensed Agents:
BidYourself.com (Will Cupp) may, at its discretion, pay a referral fee to any licensed real estate agent who represents a Buyer. If you are a licensed agent and wish to receive a referral fee, a referral request must be submitted prior to bidding. No exceptions will be made to this process.

Auctioneer’s Role and Representation:
BidYourself.com (Will Cupp) will not represent any Buyer in this auction. We will solely be working with the Seller. The Auctioneer's role is to conduct the auction and facilitate the sale for the Seller. All earnest money for the property will be held by BidYourself.com.

By participating in the auction, you acknowledge and accept the above terms regarding the Auctioneer’s role, the importance of seeking your own representation, and the referral fee structure.
